Celandine is a firm of Independent Financial Consultants situated in the historic and beautiful town of Monmouth. The Celandine, with it's fervour, patience, dedication, and even it's medicinal qualities, is an association of which we are proud.
The name Celandine derives from one of the earliest spring flowers, which can be seen in abundance at the beginning of spring right through to October, providing a carpet of delightful yellow over the surrounding countryside, along hedgerows and sheltered riverbanks. William Wordsworth, who was a frequent visitor to the banks of the River Wye, wrote of the Celandine:
"when hailstones have been falling swarm on swarm;
or blasts the green field and the trees distressed;
oft have I seen it muffled up from harm;
in close self shelter, like a Thing at rest"

It is a fact that an amazing 70% of the UK population do not have a Will. Do married couples assume they will inherit all of their partner's estate on their death? This is untrue, under the rules of intestacy, a spouse with children will be entitled to the first £125,000 only and a life interest in half of the remainder.
A Will is not solely concerned with passing on your worldly goods to another of your choice but can also be a valuable document enabling you to mitigate against the effects of long term care costs and inheritance tax. It is also an essential tool in providing for members of your family who are not recognised by the rules of intestacy, such as unmarried partners, step children or elderly parents who rely on you.
I believe one of the most important reasons to make a Will is the peace of mind it affords, lessening the burden of your death on loved ones. It costs very little to make a Will but the costs of avoiding this obligation can be very high.

Where there is no Will, your property will pass under the Laws of Intestacy which sets out a ‘pecking order' as to whom should benefit. With no living relatives at the time of your death, your estate will pass to the Crown.

Inheritance Tax is payable on death at a rate of 40% on assets held in excess of £300,000 (current tax year, 2007). This tax can be easily avoided through careful planning within your Will. This is probably the most cost efficient way of saving your estate a hefty tax bill on your death.
Any property passing to a spouse on death is free of tax however without planning the effect of the increase in the survivor's estate on their death can lead to a significant tax bill.
Husbands and wives could leave Nil Rate Band Discretionary Trusts in their Wills. On the death of the spouse the balance of the nil rate band is placed into a Discretionary Trust created in the Will without prejudice to the survivor's comfort or security as the trustees have complete discretion on the distribution of the fund. Did you know that the Treasury pockets over £1billion a year in inheritance tax?

Trusts can easily be created in your Will, an advisable solution where there is a need to protect or preserve assets. Trust are also important where provision needs to be made for minor children and infirm, disabled or mentally ill beneficiaries.
Example: Mrs Caring has sole responsibility for her son, Optimistic Dan who is disabled. Mrs Caring is rightly concerned as to what would happen to Dan should she die. Without making a Will, the Court of Protection will appoint a guardian and a receiver to look after Dan's affairs. It is likely that Dan will need to go into residential care.
With advice from Celandine, Mrs Caring prepares a Will appointing Mr Nice to care for Dan and placing monies into a Disabled Beneficiary Trust for Dan's welfare and maintenance. Mrs Caring can now sleep soundly.

A Lasting Power of Attorney is a document you can sign now in which you appoint someone to act for you should you become mentally incapable of dealing with your affairs. LPAs replaced Enduring Powers of Attorney on 1 October 2007, existing EPAs made before this date are still valid.With LPAs, one can extend the Power given to attorneys to deal not only with your property and financial affairs but to make decisions on behalf of your personal welfare, including healthcare and consent to medical treatment. Whereas an EPA can be used when a person still has capacity, an LPA will only become legal once the person has lost capacity.
If you do not have an LPA and you become incapable your next of kin will have to apply to the Court of Protection for a Receivership Order appointing someone to act for you. This can be costly and timely and the courts may appoint, not your next of kin, but a Court Official. There are therefore clear advantages in executing an LPA while you are able.
